GENERAL CONTRACTING CONDITIONS

These General Conditions regulate the USE of the services offered on the websites https://www.shuttle-service-transfers.com and https://www.shuttle-service-transfers.eu, owned by the company AGENTE SERVICE TRANSFERS SL, whose identifying details appear in point 2 of these General Contracting Conditions.

These legal conditions are adapted to the different legal regulations related to the provision of online services, such as Law 34/2002 of July 11, on Information Society Services and Electronic Commerce, (amended by Royal Decree-Law 13/2012, of March 30); Royal Legislative Decree 1/2007, of November 16, consolidated general text for the Defense of Consumers and Users; Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16, Law 44/2006 of December 29, on the improvement of the protection of consumers and users; Royal Decree 1906/1999, of December 17, 1999, regulating telephone or electronic contracting with general conditions; Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and the free movement of such data; the Organic Law on Data Protection and Guarantee of Digital Rights (LOPDGDD); Law 56/2007, of December 28, on Measures to Promote the Information Society; Law 29/2009, of December 30, which modifies the legal regime of unfair competition and advertising to improve the protection of consumers and users; General Telecommunications Law 32/2003 (amended by Royal Decree-Law 13/2012, of March 30).

The use of any of the services offered on this Website implies full and unreserved acceptance of each and every one of the General Conditions indicated, as well as the Legal Notice and Privacy Policy.

Users who purchase goods through the Website acknowledge that they are of legal age (18 years of age). Any purchase made by minors requires the prior authorization of their parents, guardians, or legal representatives, who will be considered responsible for the purchase made by minors in their care. Minors must always travel accompanied by an adult passenger.

THE OWNER reserves the right to modify these General Conditions in order to adapt them to the current legislation applicable at any given time, new case law, and standard market practices.

If you disagree with all or part of these Terms, you must refrain from continuing to use the Website and/or its services.

For any questions the User may have regarding the Terms and Conditions, they may contact the Owner using the contact information provided in section 2 of this document or, where applicable, using the contact form available on this website.

1. IDENTIFICATION OF THE WEBSITE OWNER

The ownership of https://www.shuttle-service-transfers.com and https://www.shuttle-service-transfers.eu (hereinafter Websites) is held by the company AGENTE SERVICE TRANSFERS SL (hereinafter, THE OWNER), with CIF number B42658351, and registered office at AV. Contact email: booking@shuttle-service-transfers.com.

2. SERVICES OFFERED BY THE WEBSITE OWNER

The websites offer services as a “TAXI SERVICE DISTRIBUTION CENTER”.

The transport service shall not be considered under any circumstances as a tourist package within the terms established by Council Directive 90/314/EEC, of 13 June 1990, nor under the terms of Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Protection of Consumers and Users as well as other complementary laws, and therefore the company does not operate under any circumstances as a travel agency.

3. PROCESS OF CONTRACTING SERVICES

To access the services provided on our website, the CUSTOMER must follow all the steps in the online booking system, ensuring that all information provided is correct and complete, and paying the full amount for the trip.

The CUSTOMER will receive an email confirming that the HOLDER has received their request to contract the service. This communication constitutes confirmation of the transaction and the contracted services.

The CUSTOMER must print the reservation receipt to present it upon pickup by the driver. If the CUSTOMER does not present this receipt, the contracted service cannot be provided. We recommend that you print and/or download this receipt to your mobile phone or tablet and bring with you all communications with the company, in addition to the transfer receipt.

The information contained in the voucher will include the CUSTOMER'S pick-up point and destination, with the option to book a return trip. Any changes affecting this or other information must be communicated by email to booking@shuttle-service-transfers.com prior to the service date.

The customer is responsible for any increase in the cost of the service due to a change in the reservation. Thus, the reservation price will be increased by any additional kilometers traveled, including any waiting time.

The fares will be those in effect at the time of the transfer, which are established by the Transport Ministry by law and published in the Official State Gazette for the current year, including tolls and parking.

Once the contract has been formalized, the client must notify our Customer Service department of any errors detected at least 48 hours prior to the corresponding transfer service. Notifications received less than 48 hours prior to the transfer service will entitle the company to cancel the contract without penalty.

5. RATES AND PAYMENT METHOD

The price will be the one shown at any given time on our Website, except in the case of obvious errors. If we discover an error in the price of any of the services you have contracted, we will inform you as soon as possible and give you the option to reconfirm your contract at the correct price or cancel it. If we are unable to contact you, the contract will be considered canceled, and you will be fully refunded.

The accepted payment methods are: Paypal, credit or debit card, cash, and Bizum (by sending a Bizum to the mobile number 680 902 962).

Credit cards are subject to verification and authorization by the issuing bank. If the bank does not authorize payment, the CARDHOLDER will not be liable for any lack of service and will not be able to enter into any contract with the User.

Once the HOLDER receives the User's contract request through the Website, a pre-authorization will be made on the corresponding card to ensure sufficient funds are available to complete the transaction. The card will be charged at the time the User is sent confirmation of the service provided in the manner and, where applicable, at the specified location.

In any case, by clicking "MAKE PAYMENT," the CUSTOMER confirms and acknowledges that they are the legitimate holder of the credit/debit card. If the credit/debit card holder is not you, it will be your responsibility to ensure that you have the cardholder's consent before entering any related information and that such information, when entered, is accurate.

6. CANCELLATION POLICY.

Any cancellation of service contracts must be made in writing by email to booking@shuttle-service-transfers.com.

If your cancellation request is received more than 24 hours prior to the pickup time of the transfer service you wish to cancel, the CUSTOMER will be refunded the full amount corresponding to that transfer. No refund will be made if the cancellation is made less than 24 hours prior to the scheduled time of the transfer service you wish to cancel. In this case, the CUSTOMER will receive an email confirming the cancellation so they can use it to claim the amount from their tour operator, airline, or insurance company.

If the HOLDER is forced to make any significant changes to the terms of the service, or to cancel the service, the HOLDER will inform the CUSTOMER as soon as possible, refunding the full amount paid for the contracted service.

7. DISCLAIMER OF LIABILITY

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control ("Force Majeure Event").

The HOLDER is not responsible for changes, delays, or cancellations of the service due to Force Majeure or any other unfavorable or unforeseen circumstances beyond the drivers' control.

Likewise, the OWNER is not responsible for any incidents that may occur during the provision of the service, unless such incidents are a direct consequence of negligence on the part of the OWNER.

8. SEATS FOR BABIES AND CHILDREN

For safety reasons, we recommend that you use a booster seat or baby seat for passengers under 12 years old or shorter than 135 cm. During the booking process, you will have the opportunity to reserve child seats or booster seats at all our destinations. It is the CUSTOMER'S responsibility to ensure that the restraint system is compatible with the vehicle and is installed correctly. The driver is not liable for any incidents arising from misuse or incorrect installation of the restraint system.

 

All children and infants, regardless of age, will be taken into account when determining vehicle capacity and must therefore be included in the total number of passengers when booking.

9. RESERVATIONS FOR PEOPLE WITH REDUCED MOBILITY AND WHEELCHAIRS

Transfer services for passengers with reduced mobility must be requested through our email address booking@shuttle-service-transfers.com. Passengers with reduced mobility must be able to access the vehicle independently or with the assistance of a companion.

10. TRAVELING WITH LUGGAGE AND PETS

In order to provide a vehicle tailored to your needs, the customer must indicate the type of luggage they will be bringing on the trip at the time of booking, paying the applicable fee.

Our prices include one bag or suitcase per passenger (based on a maximum combined size of 158 cm, length width height). All baggage must be reported when booking. Smaller items that can be carried in the passenger's footwell (e.g., a laptop, small handbag, or shoulder bag) do not need to be reported. The passenger will be responsible for all additional charges if an extra vehicle is required for baggage not reported at the time of booking. Excess baggage and bulky items may incur an additional charge.

If you are traveling with your pet, the CUSTOMER must inform you of this at the time of booking. Pets must be transported in their carrier, with the exception of guide dogs.

11. NULLITY

If any of these Conditions are declared null and void by a final decision issued by a competent authority, the remaining clauses will remain in force, without being affected by said declaration of nullity.

12. COMPLAINTS AND CLAIMS

The CUSTOMER may send the OWNER any complaints, claims, or any other comments they wish to make using the contact information provided in section 2 of these Terms and Conditions.

In addition, the OWNER has official complaint forms available to consumers and users, which they can request from the OWNER at any time, using the contact information provided in section 2 of these Terms and Conditions.

Likewise, if a dispute arises from the conclusion of this purchase contract between the OWNER and the CUSTOMER, the User as a consumer may request an out-of-court dispute resolution process, in accordance with EU Regulation No. 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes. This method can be accessed through the website: http://ec.europa.eu/consumers/odr.

13. APPLICABLE LEGISLATION AND JURISDICTION

Access, browsing, and/or use of this Website and any contracts for the purchase of services and/or products through it shall be governed by Spanish law.

Any controversy, problem, or disagreement arising from or related to access, navigation, and/or use of the Website, or with the interpretation and execution of these Conditions, or with the sales contracts between the OWNER and the User, shall be subject to the non-exclusive jurisdiction of the Spanish Courts and Tribunals.
